Terms & Conditions of Sale

All equipment is offered "as is, where is, with all faults," unless otherwise stated in writing. The Machine Warehouse, LLC makes every effort to ensure the accuracy of descriptions and specifications; however, no guarantee or warranty is expressed or implied regarding completeness or accuracy.

All quotations and pricing are subject to change without notice. All prices are F.O.B. location unless otherwise specified. Applicable taxes, duties, or fees are the sole responsibility of the buyer.

Payment shall be made in U.S. funds by wire transfer, check, or other approved method. Title to goods shall not transfer to the buyer until full payment has been received.

All orders are subject to availability. The Machine Warehouse, LLC reserves the right to cancel or refuse any order prior to shipment if equipment becomes unavailable or circumstances change.

Delivery dates are estimates only and may be subject to delays beyond our control, including but not limited to acts of God, supply chain disruptions, transportation issues, or other unforeseen circumstances.

The Machine Warehouse, LLC is not responsible for delays or damages incurred during transport. All claims for shipping damage must be made directly with the carrier.

Unless explicitly stated in writing, all equipment is sold "as is, where is, with all faults."

The Machine Warehouse, LLC makes no warranties, expressed or implied, including but not limited to merchantability or fitness for a particular purpose. Any warranties, if applicable, are solely those provided by the original manufacturer.

Under no circumstances shall The Machine Warehouse, LLC be liable for any indirect, incidental, consequential, or special damages, including but not limited to lost profits, loss of use, or damage to other equipment.

The maximum liability of The Machine Warehouse, LLC shall not exceed the purchase price paid for the equipment.

Buyers are strongly encouraged to inspect all equipment prior to purchase. All specifications, descriptions, and conditions are subject to buyer verification.

Final determination of suitability for any intended use is the sole responsibility of the buyer.

It is the buyer's responsibility to ensure that all equipment complies with applicable safety standards, laws, and regulations, including OSHA requirements.

The Machine Warehouse, LLC makes no representation that any equipment meets current safety standards or regulatory requirements.

The buyer assumes all risk and liability arising from the use, operation, or possession of the equipment and agrees to indemnify and hold harmless The Machine Warehouse, LLC from any claims, damages, or liabilities resulting from such use.

These terms shall be governed by and construed in accordance with the laws of the State of North Carolina. Any disputes arising out of or related to these terms shall be subject to the exclusive jurisdiction of the courts located in Union County, North Carolina.
